Terms of Service

These Terms of Service ("Terms") govern your access to and use of Writing Studio, an AI-assisted writing application available at writingstudio.com and app.writingstudio.com (the "Service"), operated by Writing Studio Ltd (trading as "Writing Studio," "we," "our," or "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. If you are using the Service on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

2. The Service

Writing Studio helps you write, edit, and cite academic and professional documents, using artificial intelligence models (including models provided by Anthropic) to offer autocomplete suggestions, editing assistance, chat-based help, and document reviews. Some features are available without an account; creating an account lets you sync usage limits and, depending on your plan, access additional features.

3. AI-generated content is not guaranteed to be accurate

The Service uses large language models to generate suggestions, edits, and written content. AI-generated output can be incomplete, inaccurate, or contain errors, including incorrect citations or factual claims. You are solely responsible for reviewing, verifying, and editing any AI-assisted content before submitting, publishing, or relying on it. The Service is a writing aid, not a substitute for your own judgment, research, or your institution's academic integrity policies.

4. Accounts and subscriptions

You are responsible for maintaining the security of your account and for all activity that occurs under it. Some features require a paid subscription. Subscription plans, pricing, and usage limits are described on our pricing page and may change from time to time; we will give you reasonable notice of material changes to pricing. Subscriptions renew automatically unless cancelled before the renewal date. Payments are processed by Stripe; we do not store your full payment card details.

5. Your content

You retain all ownership rights to the documents, drafts, and other content you create or upload using the Service ("Your Content"). We do not claim ownership over Your Content. By using AI features, you authorize us to send the relevant portions of Your Content to our AI processing providers solely to generate the requested suggestion, edit, chat response, or review. We do not use Your Content to train AI models.

You are responsible for ensuring you have the necessary rights to any content you upload or submit to the Service, and that it does not infringe the rights of others or violate applicable law.

6. Local storage

Depending on how you use the Service, some or all of Your Content may be stored locally in your browser rather than on our servers. We are not responsible for content loss resulting from clearing your browser data, switching browsers or devices, or similar actions outside our control. We recommend exporting important documents regularly.

7. Acceptable use

You agree not to use the Service to generate or distribute unlawful, infringing, or abusive content, to attempt to circumvent usage limits or security measures, to reverse-engineer the Service, or to use the Service in a way that violates any applicable law or third party's rights.

8. Third-party services

The Service relies on third-party providers, including Anthropic for AI processing, Clerk for authentication, and Stripe for payments. Your use of the Service is also subject to the applicable terms of those providers where relevant. We are not responsible for outages or issues caused by third-party providers outside our control.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ends, though these Terms will continue to apply to your prior use of the Service.

10. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Writing Studio will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including damages resulting from reliance on AI-generated content. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Service after a change constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of New Zealand, unless otherwise agreed in writing.
